Ruma Mondal versus
The State of West Bengal & Ors.
Md. Sabir Ahmed, Mr. Prasun Mukherjee, Mr. Subhamoy Dutta ... For the Petitioner.
Mr. Suman Sengupta, Mr. Sambuddha Datta, Mr. Sanatan Panja … For the State.
Affidavit-of-service filed in Court today be kept with the record. The petitioner is aggrieved by the fact that although the petitioner being the mother of private respondent no.5 is residing at a separate location, the son being inebriated comes to the residence of the petitioner, threatens, tortures both physically and mentally and also harasses the petitioner and her husband. To that effect, earlier information was furnished to the police authorities, but since there were emotional attachments, petitioner could not at the relevant point of time in the year 2023 be strict upon the police authorities to take action in accordance with law. Mr. Ahmed, learned advocate appearing for the petitioner submits that presently the petitioner’s state is such that tortures inflicted upon the parents are unbearable and as such, if the police authorities take steps against the
2 son/private respondent no.5 herein, there would not be any request from the side of the parents. Mr. Sengupta, learned advocate appearing for the State submits that the police authorities would keep a strict vigil. To that effect, a lady police personnel will every alternate day, for a period of thirty days, visit the petitioner and take information as to whether there has been any interference by the private respondent no.5 so far as their day-to- day life is concerned. In case the police personnel finds that there has been interference, she would report to the Officer-in-Charge, Golf Green Police Station who would take steps in accordance with law. With the aforesaid observations, the writ petition being WPA 17672 of 2025 is disposed of. There will be no order as to costs. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
