THE HONOURABLE SRI JUSTICE T.C.D.SEKHAR WRIT PETITION No.28742 OF 2025 The Court made the following order:
1. It is the case of the petitioner that she was appointed as a temporary Fair Price Shop Dealer of Shop No.0817035 of Kukatlapalli Village, Ballikurava Mandal, Bapatla District vide proceedings Rc.No.B/141/2015, dated 20.08.2015.
It is the further case of the petitioner that, since the date of her appointment, she has been distributing essential commodities to the cardholders to the utmost satisfaction of the concerned authorities, without there being any complaint whatsoever. 2. It is further case of the petitioner that, while so, on 02.07.2025, the 5th respondent, along with the Revenue Inspector, Parchur and other officials inspected the petitioner’s Fair Price Shop and found certain variations. Thereafter, a panchanama was drawn in the presence of the mediators and seized the stock from the petitioner’s Fair Price Shop. In pursuance thereto, the 3rd respondent issued a show-cause notice dated 07.07.2025, asking the petitioner as to why disciplinary action shall not be initiated against her. The petitioner claims that she submitted explanation dated 15.07.2025 to the 3rd respondent and the same is under consideration. 3. It is the case of the petitioner that without passing orders pursuant to show-cause notice dated 07.07.2025, the respondents, for the reasons best known to them, stopped the supply of essential commodities. Aggrieved by the said action, the present writ petition is filed. 4
4. Today, when the matter is taken up for hearing, the learned Assistant Government Pleader for Civil Supplies placed copy of written instructions dated 14.10.2025 furnished by the 3rd respondent. On perusal of the same, it is clear that the explanation submitted by the petitioner is under consideration. 5. The instructions further stated that the 3rd respondent had called for a factual report from the 4th respondent by letter dated 05.08.2025 and the same is yet to be received. 6. On consideration of the submissions made by either side and on perusal of the material available on record, it is clear that though show-cause notice dated 07.07.2025 was issued to the petitioner, no action has been taken thereafter, either by suspension order or cancellation of the petitioner’s authorization. In the absence of any such order, the 3rd respondent is bound to supply essential commodities to the petitioner. 7.
In view of the above, the present writ petition is disposed of by directing the 3rd respondent to supply essential commodities to the petitioner’s fair price shop, forthwith. It is further made clear that this order will not preclude the 3rd respondent to finalize the proceedings initiated against the petitioner pursuant to the show-cause notice dated 07.07.2025. 8. With the above direction, the writ petition is disposed of. There shall be no order as to costs. 5
