OD-6 IN THE HIGH COURT AT CALCUTTA (Testamentary and Intestate Jurisdiction) ORIGINAL SIDE PLA/25/2025 IN THE GOODS OF: ARATI MUKHERJI (DEC.) BEFORE: The Hon'ble JUSTICE OM NARAYAN RAI Date : 1st September, 2026 Appearance: Ms. Sananda Gangui, Adv. …for the petitioner The Court:- This is an application for grant of probate of the last Will and Testament dated November 25, 2022 left behind by the abovenamed deceased. The husband of the deceased pre-deceased her. The testatrix is survived by two legal heirs being her son and married daughter. The son is the executor and the applicant before this Court. The married daughter being the only other legal heir has not come forward to oppose the grant despite issuance of citation. A ‘No Caveat Certificate’ has been issued by the Department which indicates that despite issuance of citation no caveat has been entered against the grant of probate of the aforesaid Will. The Will has been proved in common form by both the attesting witnesses. Having regard to the above, since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the Department, therefore, considering the view of the Department, this application for grant of probate is allowed by passing orders in terms of prayer (d) of the application. PLA/25/2025 stands disposed of. (OM NARAYAN RAI, J.) S.Bag
