2025:JHHC:10476 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 706 of 2025 ------ Chandan Kumar son of Anant Lal Nayak resident of Village and P.O. Chirudih, P.S. Nawadih, District Bokaro (Jharkhand) .... .... …. Petitioner Versus State of Jharkhand .... .... .... Opp. Party CORAM: HON'BLE MR. JUSTICE GAUTAM KUMAR CHOUDHARY For the Petitioner : Mr. Suraj Kishore Prasad, Advocate For the State : Mr. Pankaj Kumar, P.P. ------ Order No.05 Dated : 04.04.2025 Heard both the sides. The petitioner- Chandan Kumar is in custody since 12.07.2022 in connection with S.T. No.886 of 2022 arising out of Chutia P.S. Case No. 151 of 2022 for the offence registered under Sections 302/34 of the IPC pending in the Court of learned Additional Judicial Commissioner III, Ranchi Earlier bail application of this petitioner was rejected twice on merit vide order dated 23.08.2023 and 12.04.2024 and the present bail application has been renewed on the ground that only evidence against this petitioner is the disclosure statement said to be made by him. Although seizure list witnesses of the weapon of offence have supported the case, but there are material contradictions in their statement, which cast serious doubt on the recovery made on the basis of disclosure statement. Learned A.P.P. opposed the prayer for bail. This Court is of the view that appreciation of evidence while hearing the bail application will prejudice the trial. I do not find any new ground for considering the bail application. Accordingly, the prayer for bail of the petitioner, is hereby, rejected. Learned trial Court is directed to expedite the trial.
