JUSTICE BUDI HABUNG ORDER Date : 22-06-2026 Heard Ms. O. Perme, learned counsel for the petitioners and Ms. S. V. Darang, learned counsel for the sole respondent. 2. The present application under Section 528 of the BNSS, 2023, challenges the order dated 28.04.2025 passed by the learned Court of Judicial Magistrate First Class, Yupia, in Maintenance Case No. 32/2024, whereby the prayer for interim maintenance of the petitioners was rejected on the ground that the parties were never socially or legally married. 3. It is submitted that vide order dated 25.02.2026, upon the agreement of the parties, the matter was referred to the Special Mediation Drive – “Mediation for the Nation” for settlement through mediation. Accordingly, both the parties participated in the mediation proceedings and on 19.06.2026, the matter was settled amicably through mediation in terms of the Mutual Agreement dated 25.05.2026 executed between the parties. 4. It is submitted that the respondent amongst others has agreed on the following: (i) That he would bear the school fees of the minor son, who is petitioner No. 2 in the present proceedings, till he attains the age of majority, i.e., 18 years. (ii) That he would pay a monthly maintenance amount of Rs. 8,000/- (Rupees Eight Thousand) for the minor son till he attains the age of 18 years. Page No.# 3/4 (iii) That he would pay an additional amount of Rs. 5,00,000/- (Rupees Five Lakh) towards an Educational Policy and the said amount has already been paid through an ICICI Bank cheque bearing No. 000382. The receipt of the said amount has also been acknowledged by the petitioners. The respondent has also opened a bank account in the name of petitioner No. 2, into which the monthly maintenance amount of Rs. 8,000/- (Rupees Eight Thousand) shall be deposited directly. 5. Ms. O. Perme, learned counsel for the petitioners, submits that in view of the agreement entered into between the parties, the grievances of the petitioners have substantially been complied and thus, the matter has been amicably resolved, therefore, they would have no further grievance against the respondent if the respondent undertakes to fully comply with the agreement. She, therefore, prays that this petition be disposed of in terms of the Mutual Agreement dated 25.05.2026 and the mediation settlement dated 19.06.2026. 6. Learned counsel for the respondent submits that all the terms and conditions of the agreement dated 25.05.2026 shall be continued to complied with. 7. In view of the submissions made by the learned counsel for the parties and upon perusal of the Mutual Agreement dated 25.05.2026 and the mediation settlement dated 19.06.2026 arrived at between the parties in the Special Mediation Drive – “Mediation for the Nation”, this Court finds that the grievances raised in the present petition stand adequately addressed and there remains nothing to adjudicate upon. 8. Accordingly, the present criminal petition stands disposed of in terms of the Page No.# 4/4 Mutual Agreement dated 25.05.2026 and the mediation settlement dated 19.06.2026 and the parties shall remain bound by the terms contained therein. 9.
