(At Present Accused Petitioner Confined In Central Jail Bharatpur) ----Petitioner Versus Union Of India, Through Pp ----Respondent For Petitioner(s) : Ms. Saroj Kumari Trivedi For Respondent(s) : Mr. Tej Prakash Sharma, Spl.P.P.
HON'BLE MR. JUSTICE NARENDRA SINGH DHADDHA
Order 04/02/2025
1. The present second bail application has been filed by the accused petitioner under Section 483 B.N.S.S. in connection with FIR No. VIII (IO) 15/NCB/JZU/2021 Registered at Police Station NCB Jodhpur for the offence(s) under Sections 8/15, 25 and 29 of NDPS Act.
2.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since long. Learned counsel further submits that co-accused Bhuttaram has been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 23.10.2024. Conclusion of trial will take time. So, the petitioner be enlarged on bail.
3. Learned Special Public Prosecutor appearing for Union of India has opposed the second bail application and submitted that petitioner was enlarged on interim bail for 3 days by this Court
[2025:RJ-JP:4762] (2 of 2) [CRLMB-584/2025] vide order dated 28.02.2022 but he had not surrendered before the trial Court and absconded. So, looking to the conduct of the petitioner as also the fact that only one witness is left over to be examined by the trial Court and the trial is going to be concluded very soon, the second bail application filed by the petitioner be dismissed.
4. I have considered the arguments advanced by counsel for the petitioner as well as learned Special Public Prosecutor.
5. Allegation against the petitioner is that the petitioner and co- accused were transporting contraband articles (Doda Posht) weighing 619.8 kg. Petitioner was enlarged on interim bail by this Court vide order dated 28.02.2022 but he absconded after completion of three days’ interim bail, trial is going to be concluded very soon as only one witness is left over to be examined by the trial Court, so, looking to the nature of allegations and conduct of the petitioner, I do not consider it a fit case to enlarge the petitioner on bail.
6. The second bail application is accordingly dismissed.
