The petitioner complains that inspite of an ad interim injunction order in respect of an illegal construction being passed by the Civil Judge (Jr. Divn.), 1st Court, Howrah in TS 575 of 2024, the private respondents have been pursuing their illegal act and activities. To that effect, the Inspector-in-charge of Panchla Police Station was informed, but, till date, no steps have been taken.
As none appears on behalf of the State, Mr. Raja Ram Banerjee, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. His appearance may be regularized
by the concerned authorities.
Having regard to the fact that such order was passed ex parte, I am of the view that for breach of such order, the petitioner would approach the civil court for necessary directions upon the police authorities.
In the meantime, the police authorities would only ensure that there is no violation of any law and order which is blown out of proportion.
With the aforesaid observations, WPA 18489 of 2024 is disposed of.
Pending application(s), if any, is also disposed of.
