Heard the parties.
2. The petitioner has been made accused in connection with S.T. Case No. 230 of 2023 arising out of Khunti P.S. Case No. 66 of 2023 corresponding to G.R. Case No. 433/2023, for the offences registered under Section 302 of the I.P.C., pending in the Court of learned Additional Sessions Judge-III, Khunti.
3. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 2541/2025 by order dated 02.04.2025.
4. During the intervening night of 16/17.05.2023, the petitioner is alleged to have assaulted the mother of the informant namely Kairi Mundu by lathi, due to which she succumbed to her injuries.
5. Report regarding the stage of trial earlier called for, has been received. It appears that out of five charge-sheeted witnesses, only one witness has been examined till date.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is in custody for more than two years. It was further submitted that even assuming the occurrence to be true, case under Section 304 Part-II of the I.P.C. will be made out.
7. In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III, Khunti in connection with S.T. Case No. 230 of 2023 arising out of Khunti P.S. Case No. 66 of 2023 corresponding to G.R. Case No. 433/2023.
