Chaturvedy, Adv. For the Respondent : Spl.P.P 04/18.11.2025 Heard Mr. A.K. Chaturvedy, learned counsel for the appellant and learned Spl.P.P. This appeal is directed against the order dated 17.09.2025 passed in A.B.P. No.393 of 2025 arising out of Latehar P.S. Case No. 283 of 2021 by the learned Sessions Judge, Latehar whereby and whereunder the prayer for anticipatory bail of the appellant has been rejected. It has been alleged that one Sarfuddin Khan was apprehended by the Police and from his possession some incriminating materials including Potash were recovered. It has been submitted by learned counsel for the appellant that the appellant has been implicated on the confessional statement of Md. Sarfuddin Khan. It has further been submitted that there were no incriminating materials, save and except the confessional statement so far as the appellant is concerned. Learned Spl.P.P has submitted on instruction that the appellant does not have any criminal antecedent and has accepted the fact that the only incriminating material against the appellant is the confessional statement of Sarfuddin Khan. On consideration of the aforesaid facts, we while setting aside the order dated 17.09.2025 passed in A.B.P. No.393 of 2025 arising out of Latehar P.S. Case No. 283 of 2021 by the learned Sessions Judge, Latehar, direct the appellant to surrender before the learned trial court within a period of four weeks and on his surrender he shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two 2 sureties of the like amount each, to the satisfaction of learned Sessions Judge, Latehar in connection with A.B.P. No.393 of 2025, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023. This appeal stands allowed and disposed of. (Rongon Mukhopadhyay, J.)
