GP FOR HOME The Court made the following Order: The learned counsel for the petitioner submits that the petitioner is running Tea & Snacks Stall No.93 at NTR Bus Station, Guntur, and that the said shop was allotted vide order dated 08.07.2024 by the APSRTC. It is submitted that the 3rd respondent is interfering with the petitioner’s business, which is affecting the Fundamental Right to life. It is also submitted that the petitioner has validly obtained the lease from APSRTC to run the tea stall. Further, it is submitted that the petitioner started running the tea stall from 08.07.2024, and that prior to the petitioner, some other person was running 2 the tea stall in the said premises. It is further submitted that the 3rd respondent, at the behest of business rivalry, is causing hindrance to the petitioner in running the tea stall. 2. The learned Assistant Government Pleader appearing for respondent Nos.1 to 3 on written instructions submits that the petitioner’s shop is on the entrance to the shop is towards the Vijayawada Guntur main road, and that passengers face many problems during night time due to drinkers and chain snatchers, and that keeping the shop open at night will cause law and order problems. It is also stated that there is no proper parking place for the petitioner’s shop. It is further submitted that keeping the shop open after odd hours is causing traffic issues, and hence, prays for dismissal. 3. Admittedly, the petitioner is running a Tea Stall under a valid license dated 07.10.2024, and the license is valid till 06.10.2029. The petitioner is also required to pay a license fee of Rs.26,790/- per month, with an escalation of 10% and 15% in the 4th and 5th year respectively. 4. Considering the submissions of the learned counsel for the petitioner and the learned Assistant Government Pleader, there shall be a direction to the 3rd respondent not to disturb the petitioner’s business, and the 3rd respondent may also take appropriate steps for regulating the traffic at that place. If necessary, a traffic constable is to regulate the traffic to avoid inconvenience to the commuters. The 3rd respondent shall deploy a traffic 3 constable to regulate and ensure there is free ingress and egress to the bus station. 5. With these observations, this Writ Petition is disposed off.
