(Hon’ble Shri Justice Arvind Kumar Verma) Order on Board 07/08/2025 By way of this petition, the petitioner is challenging the legality and validity of the order/letter dated 20.05.2025 passed by the respondent No.3/Collector whereby instead of the compensation being released in lieu of land acquisition, the matter has been forwarded to respondent No.2 under Section 76 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Contention of the counsel for the petitioner is that the compensation amount has not been released in favour of the petitioner after his land was acquired for the Saradih barage project construction at Dabhra, District Janjgir-Chanpa, District Sakti. He therefore submits that he ha filed representation before the respondent No.3/Collector regarding non-granting of compensation by the respondent No. 4 on 03.03.2023. The grievance of the petitioner for non-granting of compensation may be resolved. He therefore submits that the present petition may be disposed of with a direction to decide his representation. He has submitted the letter of the Registrar, Land Acquisition, Rehabilitation and Resettlement Authority dated 01.08.2025 stating that there is no post of Presiding Officer vacant and therefore the case has not been decided. From perusal of the documents and the grievance of the petitioner, it appears that the land of the petitioner has been acquired and amount of compensation has been assessed by the Land Acquisition Officer but the petitioner has not been awarded the said compensation.
Therefore, the
3 Collector is directed to decide the case of the petitioner as the award has already been passed by the Land Acquisition Officer by taking necessary steps for disbursal of the land acquisition compensation to the petitioner towards his land acquired by the respondent. The matter is pending before the Registrar, Land Acquisition, Rehabilitation and Resettlement Authority therefore the same may be sent back to the Collector to decide in accordance with law within a period of 60 days from the date of its receipt.
