Heard Shri Manoj Kumar Tripathi, learned counsel for the applicants, Shri Manoj Kumar Dubey, learned counsel for respondent no.2 as well as learned A.G.A. and perused the record on Board. 2. The applicants have invoked the inherent jurisdiction of this Court under Section 482 Cr.P.C. for quashing the entire proceedings of Charge Sheet dated 14.08.2022 as well as cognizance/summoning order dated 13.09.2022 in Criminal Case No.799 of 2022 (State Vs.Raj Kumari and others), arising out of Case Crime No.276 of 2022, under Sections 323, 325, 327 IPC, Police Station Babugarh, District Hapur, pending in the court of Judicial Magistrate 1st, Hapur. 3. It is submitted that the instant matter is arising out of matrimonial discord. It is further submitted that the matrimonial discord between husband and wife has already been settled by Settlement Agreement dated 22.11.2023 through mediation process from the Mediation and Conciliation Centre of this Court in connected Application U/S 482 No.12826 of 2023. The detail order has been passed in the connected application and proceedings has been quashed. 4. Accordingly, on the basis of the settlement agreement dated 22.11.2023 took place between the parties before Mediation and Conciliation Centre of this Hon'ble Court, the instant application under Section 482 Cr.P.C. is hereby allowed as well and the entire criminal proceeding of the aforementioned case is hereby quashed. 5. Let a copy of the order be transmitted to the concerned lower court for necessary action.
