CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 3 21-04-2025 Heard Mr. Harish Kumar, learned counsel appearing on behalf of the petitioner and learned GA-12 for the respondent/s.
2. The petitioner in paragraph no. 1 of the present writ petition has sought inter alia following relief(s), which is reproduced hereinafter:
"(i) For issuance of appropriate writ/ writs, direction/directions, order/orders directing the concerned respondent to consider the petitioner as a qualified candidate of S.T.E.T. Exam held in 2019 having obtained 66.5075% marks belonging to schedule class category. (ii) For issuance of appropriate writ(s)
order(s) / direction(s) directing the concerned respondent to consider the petitioner in order of merit as the candidate belonging to Backward class having obtained 67.6962 has been declared as qualified while petitioner being a candidate of schedule cast with 66.5075 has been declared not qualified. (iii) Any other relief/s which the petitioner may be found entitled to, in the facts and

3. Petitioner has claimed that he belongs to Schedule Caste and cut off marks for this class was 45 percent while for General Category, it was 50 percent, which he admits in paragraph no. 9 of the writ petition.
4. A counter affidavit has been filed on behalf of the Bihar School Examination Board in which, in paragraph no. 13, it has been stated that petitioner scored only 44.3383 percent, which is less than 45 percent in terms of the stipulated terms and conditions of the advertisement.
5. In view of the information contained in paragraph no. 13 of the counter affidavit, as well as, the petitioner's own admission on paragraph no. 9 of the writ petition and in terms of the advertisement, I find no merit in the present writ petition.
6. Accordingly, the present writ petition is consigned.
