No one appeared on behalf of the applicant to press this application. However, Sri D.P.S. Chauhan, learned A.G.A. is present. 2. The instant application has been filed to release the applicant on bail in case crime No. 297 of 2022, under Sections 380, 457, 411 IPC, P.S. Cantt. District Gorakhpur. 3. On perusal of the record, it is clear that an F.I.R. was lodged against unknown persons by the first informant for committing theft in his house. Subsequently, the police on receiving the information arrested the applicant and recovery of stolen articles of jewellery were also made from the applicant as well as other accused persons. It is also clear from the record that the applicant has a criminal history of 31 cases wherein most of the cases relate to theft, robbery, attempt to murder and also the Gangsters Act. 4. Considering the aforesaid facts and circumstances that the stolen articles of jewellery have been recovered from the possession of the applicant and his criminal history of similar nature shows that he is a habitual offender, therefore, this Court is not inclined to enlarge the applicant on bail for the reason that there are chances that the applicant will again commit similar offences. 5.
