Learned counsel for petitioners submits that petitioners are facing trial in Criminal Case No. 783/2021 for alleged offence U/s. 498-A of I.P.C.. Charges in the aforementioned criminal case were framed against petitioners on 29.07.2022 and thereafter the first date fixed for recording of evidence of prosecution witnesses was on 16.09.2022. 2 and 11 months. He contended that petitioners are father-in-law and mother-in-law aged about 68 and 64 years, therefore, direction be issued to learned trial Court to conclude the proceedings pending in criminal case at the earliest.
2. Learned State counsel submits that, perusal of order sheet would show that summons have been issued to prosecution witnesses on number of occasions, however, as per order sheet, summons issued to prosecution witness No.1 to 3 is not returned either served or unserved.

Considering the submission of learned counsel for the parties and further taking into consideration the fact that charges against petitioners were framed on 29.07.2022 and since then about more than two years and eleven months have already been elapsed, as submitted by learned counsel for petitioners, none of prosecution witness is examined till date, this petition is disposed of directing learned trial Court to expedite the trial and conclude the proceedings at the earliest. The learned trial Court shall take all necessary steps as provided under BNSS for causing presence of the prosecution witnesses. Sd/- (Parth Prateem Sahu)
