IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA
Cr.MPM No. 2683 of 2025
Date of Decision: 29.12.2025 _____________________________________________________________________ Gopal Krishan ……...Petitioner Versus State of Himachal Pradesh
…....Respondent Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Arjun Lall, Advocate.
For the Respondent: Mr. Anup Rattan, Advocate General with Mr. Rajan Kahol, Additional Advocate General with Mr. Ravi Chauhan, Deputy Advocate General. ___________________________________________________________________________
Sandeep Sharma, J. (Oral)
By way of instant petition, petitioner has prayed for grant of regular bail in case FIR No. 145 of 2021 dated 6.8.2021, registered at PS Amb, District Una, Himachal Pradesh, under Sections 302 & 34 of IPC and Sections 25, 54 and 59 of Arms Act.
2.
Pursuant to order dated 12.11.2025, respondent State has filed status report and HC Rajeev, PS Amb, District Una, Himachal Pradesh, has come present with record. Record perused and returned.
3.
Close scrutiny of status report reveals that trial is on the verge of conclusion because at present, only one witness remains to be examined. In view of the aforesaid fact coupled with the fact that petitioner is accused
2 of heinous crime punishable under Sections 302 of IPC, this Court is not persuaded to consider prayer made by the petitioner for grant of bail on the ground of inordinate delay in conclusion of trial.
4.
Consequently, in view of the above, present petition is dismissed at this stage with direction to the learned trial court to ensure that trial is concluded expeditiously, preferably, on or before 15.3.2026, failing which this Court shall have no option, but to consider prayer made by the petitioner for grant of regular bail on account of inordinate delay in conclusion of trial. Needless to say, this Court on judicial as well as administrative sides, has been repeatedly advising the courts to conclude the trial of under trials on top most priority so that their freedom is not curtailed for an indefinite period. Registry is directed to apprise the court below with regard to passing of the instant order.
