[2025:RJ-JP:1348] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15982/2024 Satishchand S/o Shri Rajendra Singh, R/o Mangraul, Police Station Mania, District Dholpur, At Present Shastri Nagar Sector No. 5, Police Station Nihalganj, Dholpur, District Dholpur (At Present Confined In District Jail Dholpur) ----Petitioner Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Anil Jain For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 09/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 476/2024 registered at Police Station Mania, District Dholpur for the offence(s) under Sections 115(2), 126(2), 125, 352, 351(2), 351(3) of BNS. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is argued that FIR itself is delayed by two days. It is alleged in the FIR that petitioner caused injuries with the aid of stick to the injured Renu and Kanak and also pelted bricks at the house of the complainant. It is further argued that no injuries were found to the Renu and Kanak. It is also alleged against the petitioner that he opened fire at Renu and Kanak. The accused petitioner is in custody since 04.12.2024 and the trial of the case will take considerable time. [2025:RJ-JP:1348] (2 of 2) [CRLMB-15982/2024] Therefore, the benefit of bail may be granted to the accused- petitioner. Per contra, learned Public Prosecutor opposes the bail application and submitted the factual report and contended that petitioner opened fire at Renu and Kanak, therefore his bail application deserves to be dismissed. Heard and perused the material available on the record. Factual report shows that no bullets pallets or cartridges were recovered from the place of occurrence, factual report also reveals that the name of the other co-accused Chotu has been falsely stated in the FIR. It is stated that injured Kanak Sharma refused to conduct her medical examination. Accused-petitioner is behind the bars since 04.12.2024 and trial of the case will take time, therefore without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Satishchand S/o Shri Rajendra Singh, in connection with FIR No. 476/2024 registered at Police Station Mania, District Dholpur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
