JUSTICE GAUTAM KUMAR CHOUDHARY For the Appellant : Mr. Anjani Nandan, Advocate For the State : Mr. Saket Kumar, A.P.P. ------ Order No.02 / Dated : 25.11.2025 This appeal is directed against the order dated 02.09.2025 passed by learned Additional Sessions Judge-I, Bermo at Tenughat (Bokaro) in B.P. No.136 of 2025 in connection with Bermo P.S. Case No.79 of 2025 whereby and whereunder prayer for bail of the appellant has been rejected. It has been alleged that a raid was conducted in the marriage hall and the warehouse built in front of it and it was detected that an illegal gun factory was being run as well as duplicate wine was being stored. It has been submitted by the learned counsel for the appellant that the gun factory was situated in the warehouse which however did not belong to the appellant. Learned counsel submits that in fact the name of the appellant being the owner of the warehouse got transpired on the basis of confessional statement of co-accused Suraj Kumar Saw, who has already been granted bail by this Court in Cr. Appeal (D.B.) (Filing) No.23150 of 2025. Learned counsel submits that the appellant is in custody since 28.06.2025 though he has one criminal antecedent but the same relates to an offence under the Excise Act. Learned A.P.P. has opposed the prayer for bail of the appellant. The investigating agency does not appear to have ascertained as to whether the warehouse from where the illegal gun factory was being run actually belonged to the appellant or some other person. It seems that the name of the appellant being the owner of the warehouse, has come on the disclosure made by the co-accused Suraj Kumar Saw. 2025:JHHC:35392-DB On consideration of the aforesaid facts, we while setting aside the order dated 02.09.2025 passed in B.P. No.136 of 2025 in connection with Bermo P.S. Case No.79 of 2025 by the learned Additional Sessions Judge-I, Bermo at Tenughat (Bokaro), direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below.
