This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 316(2)/318(4)/61(2) of the Bharatiya Nyaya Sanhita, 2023 in connection with Giridih (T) P.S. Case No. 236 of 2024 pending in the Court of Chief Judicial Magistrate, Giridih.
3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
4. It has been submitted by the learned counsel for the petitioner that notices under section 35(3) of the BNSS has been issued to the petitioner in which the petitioner has appeared before the investigating officer. He submits that the investigating officer has not arrested him.
5. The fact that the investigating officer has not arrested the petitioner, clearly gives an impression to the Court that it is not necessary to arrest the petitioner.

6. Thus, this anticipatory bail application is not maintainable at this stage as the petitioner is cooperating in the investigation.
7. Accordingly, this Anticipatory Bail Application stands
disposed of with a direction to appear before the Court concerned as there is no apprehension of arrest.
