This petition has been filed for seeking compliance of
order dated 22.04.2025, passed in CWP No. 12214 of 2024, titled Virender Singh Khurana & others vs. The Secretary (cooperation) and others, whereby it was mandated that in case of failure on the part of Government to nominate any Director by exercising prerogative vested in it under Section 35 of the H.P. Co-operative Societies Act, 1968 by 30.06.2025, the Managing Committee of the HIMFED shall be considered to be comprised of the Members, who already stood elected/nominated, in terms of the provisions of 1 Whether reporters of Local Papers may be allowed to see the judgment?
2 Section 34(2) of the Act and the said Committee shall be at liberty to carry out its functions. It was further observed that thereafter, respondent-State shall forfeit its right to nominate any Director, at least for the remaining tenure of the present Managing Committee. It was also
directed after 30.06.2025, the Managing Director shall forthwith convene the meeting of the Committee, so as to elect the Chairman and Vice Chairman etc., as per the Statute.
2. Admittedly, during the pendency of the present petition, an application i.e. CMP No. 18419 of 2025 was filed in CWP No. 12214 of 2024 by the State for extension of time to comply with the direction contained in judgment dated 22.04.2025.
3. The aforesaid application was disposed of vide order dated 22.08.2025 by extending the time, to do the needful, up to
10.09.2025.
4. From the aforesaid facts, it is apparent that deadline set up by the court in Order dated 22.04.2025 was extended up to
10.09.2025.

It is also admitted fact that though after expiry of the time granted by the Court in order dated 22.04.2025, but during the period between 30.06.2025 and 10.09.2025 i.e. prior to expiry of extended time, respondent/State has nominated two members as Directors and one Government nominee as Chairman of the
3 HIMFED. Therefore, direction contained in judgment dated 22.04.2025 stood complied within time extended by the Court.
6. In aforesaid facts, for the nature of prayer made in present petition, without commenting upon the merits of the nominations made by the State, we are of the considered opinion that nothing survives to be adjudicated in this petition.
7. Accordingly, the present petition stands disposed of being infructuous, so also, pending miscellaneous application(s), if any, in the aforesaid terms. (Vivek Singh Thakur)
