Present applicant Ravi Sahu, S/o Suraj Prasad is praying for regular bail in relation to FIR dated 29.11.2024 registered as FIR/Case Crime No. 205 of 2024 at P.S. Mukhani Haldwani District Nainital wherein the present applicant has been implicated for the offences punishable under Sections 70(1), 64(2)(k), 87, 115 and 351(3) of BNS 2023. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated, and the charge sheet has been filed only on the basis of CCTV footages but the CCTV footages are not the part of the record on basis of which charge sheet is filed. He further submits that as per the prosecution victim was major and as per the medical report hymen was torn but in the entire medical report there is no reference of injury. He further submits that charge sheet has already been filed and therefore at this stage there is no need of custodial interrogation of the present applicant. 5. On the other side, learned Brief Holder for the State has not disputed this fact that charge sheet has already been filed, and, as such there is no need of custodial interrogation of the applicant. 6. After hearing the arguments of the learned counsel for the parties and 2025:UHC:4303 further taking into consideration that charge sheet has already been filed and there is no need of custodial interrogation of the applicant, this Court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 13. Let the applicant Ravi Sahu be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
