1IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.19853 of 2025 Date of Decision: 22.12.2025 _____________________________________________________________________ Munish Kumar Thakur ……...Petitioner Versus CSKHPKV & Ors. …....Respondents Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Avinash Jaryal, Advocate. For the respondents: Mr. Janesh Mahajan, Advocate. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) Petitioner herein, who at present is working as JOA (IT) at Mountain Agriculture Research and Extension Centre (MAREC) Salooni, District Chamba, Himachal Pradesh, is aggrieved by order dated 08.05.2025 (Annexure P-2), whereby he has been transferred from afore station to Registrar’s Office (Academic Branch), CSKHPKV Palampur. 2. Though at first instance, petitioner filed representation to the competent authority for cancellation of his transfer on the ground that he is 70% disabled, however, such request of him was rejected vide order dated 13.10.2025 (Annexure P-5). In the afore background, petitioner has approached this Court in the instant proceedings, seeking therein direction to the respondents to quash his transfer order. 3. Pursuant to order dated 16.12.2025, Mr. Janesh Mahajan, learned counsel representing the respondents, has placed on record communication dated 22.12.2025 issued under the signatures of Registrar, CSKHPKV, Palampur, to state that though though petitioner is disabled to the extent of 70% (hearing impairment), but on account of his having specialization in the computer, his services are required in the office of Registrar, CSKHPKV. Mr. Mahajan, states that services of the petitioner shall be required at Palampur for 5-6 months, thereafter he can be sent back to Salooni. 4. Since it is apparent from the pleadings adduced on record that petitioner throughout remained posted at Salooni, coupled with the fact that on account of his having specialization in computer, petitioner is required at the headquarters, there appears to be no justification to interfere with the impugned order, especially when it has been categorically stated on behalf of the respondents-University that within six months, petitioner shall be sent back to Salooni. 2 5. Consequently, in view of the above, present petition is disposed of with a direction to the respondents to ensure that petitioner is sent back to Salooni, District Chamba, Himachal Pradesh, after six months. Pending application(s), if any, stand disposed of. December 22, 2025 (Sandeep Sharma), (sunil) Judge 3
