[2025:RJ-JP:9077] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Writ Petition No. 2225/2024 Dr Chen Singh S/o Sh. Teeka Ram, Aged About 53 Years, R/o Vllage Nagalsherpur, P.S. Balghat, District Gangapur City. ----Petitioner/Complainant Versus 1. State Of Rajasthan, through Standing Counsel For State, Before The Honble High Court of Judicature For Rajasthan Bench Jaipur. 2. Director General Police, Rajasthan Police, H.Q. Jaipur. 3. Superintendent Of Police, District Gangapur City. 4. SHO/investigation Officer, P.S. Balghat, District Gangapur City. ----Respondents For Petitioner(s) : Mr. Kuballi Ram For Respondent(s) : Mr. Vijay Singh Yadav, Public Prosecutor HON'BLE MR. JUSTICE GANESH RAM MEENA Order 28/02/2025 1. The petitioner has filed this criminal writ petition with a prayer to get investigation of FIR No.176/2024 registered at Police Station Balghat, District Gangapur City on 04.10.2024 for the offences punishable under Sections 235, 246, 318(4), 336(2), 336(3), 338, 339, 340(2) & 61(2)(a) of the BNS, 2023 by the Special Investigation Team. 2. Learned counsel for the petitioner submits that since the accused is an official of the Rajasthan Police Service therefore, the petitioner requires the investigation to be conducted by an official not below the rank of Director General of Police. [2025:RJ-JP:9077] (2 of 2) [CRLW-2225/2024] 3. Considered the submissions made by counsel for the petitioner and also perused the material placed on record. 4. The petitioner has failed to place on record any evidence or material for doubting the integrity of the Investigating Officer who has conducted the investigation of the case at present. 5. This argument, merely on the basis of the statements of a party doubting the integrity of the Investigating Officer, cannot be accepted. If such allegations are accepted without there being any evidence to support such allegations then, it would be very difficult for the Investigating Officer to conduct an investigation independently. 6. Since the petitioner has failed to point out any evidence or material to support his submissions, this Court finds no ground to interfere in the matter. 7. Accordingly, this criminal writ petition is dismissed. 8. Pending application, if any, also stands disposed of. (GANESH RAM MEENA),J Ashish Kumar /114
