[2025:RJ-JP:1349] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15977/2024 Mahaveer Sharma S/o Madanlal Sharma, R/o Mehton Ki Dhani, Vilalge Bichpadi, Post Nangal Ladi, Police Station Harmara, District Jaipur West. (Accused Petitioner Presently Confined In Central Jail, Jaipur) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Sanwar Mal Sharma For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 09/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 398/2024 registered at Police Station Jaisinghpura Khor, District Jaipur City (North) for the offence(s) under Sections 376, 384, 420, 406, 467, 468 and 471 of IPC. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that prosecutrix is a married lady and she was in consensual relationship with the petitioner, prosecutrix herself in the FIR has stated the fact that she was in love with the petitioner. It is also contended that there was some money transaction between the petitioner and the prosecutrix, petitioner gave a cheque of Rs. 15,00,000/- (Rupees Fifteen Lakhs) to the prosecutrix and the said [2025:RJ-JP:1349] (2 of 2) [CRLMB-15977/2024] cheque was dishonoured on 01.10.2024, thereafter the said FIR was lodged on 08.10.2024 just to pressurize the petitioner for releasing the cheque amount. The accused petitioner is in custody since 12.11.2024 and the trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused- petitioner. Per contra, learned Public Prosecutor opposes the bail application. Heard and perused the material available on record. Considering the arguments advanced by the counsel for the parties and taken into note the delay in filing of the FIR and allegations levlled against the accused-petitioner, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mahaveer Sharma S/o Madanlal Sharma, in connection with FIR No.398/2024 registered at Police Station Jaisinghpura Khor, District Jaipur City (North) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
