O R D E R
1. The Criminal Revision Case, under Section 397 and 401 of the Code of Criminal Procedure, 1973 (for short, ‘Cr.P.C.’) is filed on behalf of the petitioner/husband assailing the Order dated 29.07.2013 passed in F.C.O.P.No.818 of 2009 on the file of the learned Judge, Family Court-cum-V Additional District and Sessions Judge at Visakhapatnam (for short, ‘Sessions Judge’) whereby the learned Sessions Judge allowed the petition in-part, which was filed by the 2nd Respondent herein under Section 125 of Cr.P.C seeking maintenance. 2. Today, when the matter is taken up for hearing, learned counsel for the petitioner is present. None appeared on behalf of the Respondent No.2. 3.
A report was received from the Secretary of the District Legal Services Authority, Visakhapatnam, stating that Respondent No. 2, Kesavapatnam Leela Kumari @ Asha, stating in her statement that her husband, Kesavapatnam Chandrasekhar (the petitioner herein), passed away on
22.11.2021. She further stated that she had amicably resolved her matrimonial disputes with him outside the Court and obtained a divorce in the year 2013. Subsequently, in 2017, she entered into a second marriage with one K. Laxman, son of the late Krishna Rao. 4. A perusal of the report reveals that the matrimonial disputes between the petitioner and his wife were amicably settled, and that the petitioner had passed away on 22.11.2021. In the said facts of the case, this Court finds that cause does not survive. 3
5. Accordingly, the Criminal Revision Case is dismissed as cause does not survive. Miscellaneous applications pending, if any, shall stand closed. _____________________________ JUSTICE T. MALLIKARJUNA RAO
