ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.1, 2 and 4 on bail in Crime No.102 of 2025 of Rampachodavaram Police Station, ASR District, was registered against the Petitioners/Accused Nos.1, 2 and 4 herein for the offences punishable under Section 8 (c) read with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’) and Section 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the allegation against the Petitioners/Accused Nos.1, 2, and 4 is that they were allegedly found in possession of 8.00 Kgs of ganja, which is not a commercial quantity. The petitioners were arrested on 06.10.2025 and they have been in judicial custody for the past 17 days. The Petitioner No.3/A-4 is of impressionable age. The Petitioner No.1/A-1 is aged about 23 years. The Petitioner/A-1 is a permanent resident of Padamati Khandrika Village, Dr. B.R. Ambedkar Konaseema District; the Petitioner/A-2 is a permanent resident of Gokavaram Village, East Godavari District; and the Petitioner/A-4 is a permanent resident of Konda Reddy Pata Veedhi,

They have got fixed abode. There are no similar criminal adverse antecedents reported against the petitioners. So far, seven witnesses have been examined, all of whom are official witnesses. Substantial portion of the investigation relating to the alleged role of the petitioners has been completed. Hence, the chances of the petitioners threatening the witnesses, hampering the investigation, or tampering with the evidence may not arise. The petitioners may not escape from the process of law as they have permanent abode. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioners/Accused Nos.1, 2 and 4, this Court is inclined to enlarge the Petitioners/Accused Nos.1, 2 and 4 on bail with the following stringent conditions: i. The Petitioners/Accused Nos.1, 2 and 4 shall be enlarged on bail subject to they executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for the like sum each to the satisfaction of the learned Judicial First Class Magistrate, Rampachodavaram. ii. The Petitioners/Accused Nos.1, 2 and 4 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet. 4

iii. The Petitioners/Accused Nos.1, 2 and 4 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioners/Accused Nos.1, 2 and 4 shall not commit or indulge in commission of any offence in future. v. The Petitioners/Accused Nos.1, 2 and 4 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. vi.
The Petitioners/Accused Nos.1, 2 and 4 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the investigating officer as and when required. 5.
