The petitioner has been made accused in connection with Pandu P.S. Case No. 58 of 2024 (POCSO Case No.101 of 2024) for the offences under Section 96 of the B.N.S., 2023 and charge has been framed under Sections 64(1)/87/139(2) of the I.P.C. and Section 4 of the POCSO Act, pending in the Court of Ms. Shika Agarwal, learned JMFC, Palamau. Petitioner is alleged to have enticed away 17 years old daughter of the informant to leave her lawful guardianship with the intention to marry her. It was submitted that the victim in her statement under Section 161 Cr.P.C. has stated that she was having affair with the petitioner and she has left her lawful guardianship according to her own wish. She has further stated that she has married this petitioner. Learned Spl.P.P. has opposed the prayer for bail. This appears to be a case of adolescent love affair between the parties. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Ms. Shika Agarwal, learned JMFC, Palamau or her successor, in connection with Pandu P.S.
