The respondent has filed HMOP.No.211 of 2017 in the Court of Principal Senior Civil Judge, Machilipatnam, Krishna District for divorce under Section 27(1)(b) of Special Marriage Act. 3. Learned counsel for the petitioner submits that it was decreed ex-parte on 24.04.2018. The petitioner applied for setting aside the ex-parte decree on 17.07.2018 and also filed an application under Section 5 of Limitation Act for condonation of delay. He submits that the application filed in the year 2018 is still pending. He further submits that on those applications the arguments of the petitioners were concluded pm 10.04.2019 itself and since then respondent-husband is continuously seeking time for the arguments. He has also annexed the copy of the docket orders which reveals the same. 4. Considering that the applications are pending since 2018 and there is ex-parte decree of divorce against the petitioner, keeping the petition pending would serve no useful purpose. Consequently, dispensing the issuance of the notice to the respondent, this Civil Revision Petition is disposed of finally with a direction to the learned Principal Senior Civil Judge, Krishna, Machilipatnam to expeditiously consider and decide the pending application No. 753 of 2018 filed under Section 5 of Limitation Act and if the delay is condoned also to decide the I.A.No.754 of 2018, with due opportunity to the respondent in accordance with law within a period of six (06) months from the date the copy of this order is placed before the said Court. 5. The Civil Revision Petition stands disposed of. 6. It is made clear that this Court has not observed anything on merits of the petition either way. No order as to costs.
