1. The Civil Miscellaneous Appeal is filed under Section 30 of the Workmen Compensation Act aggrieved by the Order dated 12.10.2009 in W.C.No.26 of 2006 passed by the Commissioner of Workmen’s Compensation and Assistant Commissioner of Labour, Anantapur. 2. The Appellant is the Claimant and the application filed by the claimant was dismissed by the Commissioner as the Claimant unable to establish the employee and employer relationship between the parties. 3. Heard the learned counsel for the Appellant. 4. This Court on 11.02.2013 passed the following Order:
“Learned counsel for Appellant(s) is/are permitted to take out fresh batta to the respondent Nos. 1 and 2 and personal notice to the Respondent/s concerned to his/her/their correct address by registered post with acknowledgment due, or by courier service, and file proof of service into the office within a period of four weeks from today, failing which the appeal stands dismissed as against whom the notice is to be served and also for non prosecution. 3
Further, if any of the respondent/s or the parties died, the appellant/s is/are directed to bring the legal representatives of the deceased on record, within four weeks from today, failing which, the appeal stands abated and liable for dismissal, for non prosecution. If any parties are necessary parties and notice is not necessary, a memo be filed to that effect for recording the same”. 5. This case was again listed on 10.02.2015 and this Court sought for clarification whether peremptory order referred above was complied with by the Appellant. As per the endorsement by the Registry, the above extracted peremptory order was not complied with by the Appellant. No application was filed seeking to recall the said Order. 6. In view of the same, the Civil Miscellaneous Appeal is dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
