GP FOR COOPERATION The Court made the following: 2 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "…..to issue a issue a “Writ of Mandamus” or any other appropriate writ, order or direction, declaring the action of the Respondents, more particularly the Respondent No.2, in issuing Termination Notice bearing Estt./Outsourcing File/2024-25, Dt.28.11.2024 and seeking to terminate the Agreement Dt.01.09.2022 unilaterally as being illegal, Arbitrary, Unconstitutional, without Jurisdiction, Violative of Principles of natural justice, in violation of Article 14, 19, 21 and to consequently set aside the same and pass such other orders…..." 2. The present Writ Petition is filed for writ of mandamus declaring the action of the respondents, more particularly, in terminating the agreement dated 01.09.2022 unilaterally on the ground that as it is being illegal, arbitrary and in violation of the principles of natural justice. 3. This Court, vide order dated 10.12.2024, suspended the impugned proceedings, termination notice dated 28.11.2024, terminating the service of the petitioner for supply of manpower and to provide housekeeping staff and security personnel to work in the bank. 4. On receipt of notice, the 2nd respondent appeared through counsel. Smt. Sesha Rajyam, learned senior counsel appearing for Sri Koteswara Rao Mummaneni, learned counsel appearing for the 2nd respondent, has suggested that the petitioner will be allowed to take part of next or upcoming tender for supply of manpower to provide housekeeping staff and security personnel to the bank and, till that time, 3 the petitioner will be permitted to supply manpower. In response to the instructions from the petitioner, learned counsel for the petitioner has approved the proposal made by the learned counsel for the 2nd respondent-bank. 5. Accordingly, the Writ Petition is disposed of, directing the respondents herein to permit the petitioner herein to participate in the upcoming tender and also to continue the petitioner till such time for supply of manpower to the bank. There shall be no order as to costs.
