Neutral Citation No. - 2025:AHC:39615 Court No. - 1 Case :- CONTEMPT APPLICATION (CIVIL) No. - 3824 of 2018 Applicant :- Bhupat Singh Yadav Opposite Party :- Sri Om Prakash, Commandant Counsel for Applicant :- Vashishtha Narayan Tripathi Hon'ble Salil Kumar Rai,J. Heard the counsel for the applicant. The present contempt application has been filed pleading willful disobedience of the order dated 8.1.2018 passed by this Court in Writ - A No. 47078 of 2012. In pursuance to the previous order passed by this Court, the Standing Counsel has obtained instructions in the matter and has handed over a copy of the same to the Court which is taken on record. On the basis of his instructions, the Standing Counsel states that after adjusting leave and other dues of the applicant as stipulated in the order dated 8.1.2018 passed by this Court, the service and retiral dues of the applicant have been paid. The chart showing payment and adjustments have also been annexed with the instructions. The counsel for the applicant points out to certain errors and illegalities in the adjustment of leave due to the applicant and on the aforesaid basis pleads that the payment made is less than what was due to the applicant. The argument of the counsel for the applicant raises an issue on the merits of the case which the applicant can raise before the appropriate forum and is not to be considered in proceedings under the Contempt of Courts Act, 1971. The application is disposed of and consigned to records. Notice issued to the opposite party is discharged.
