A RADHA KRISHNA The Court made the following: ORDER: This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:- “to issue a writ, direction, order or orders more particularly one in the nature of writ of mandamus declaring the action of the respondents in not absorbing/regularizing petitioners service as Syce though petitioner have been recruited through process of selection and continuing as temporary casual labour since 2005 by giving artificial breaks even not granting weekly holidays and not paying the wages properly and not granting any other service benefits attached to the post of Syce as illegal, arbitrary, malafide and violation of principles of natural justice and consequentially direct the respondents to consider petitioner case for regularization of his services as Syce in the respondents Department in the interest of justice 2. Heard Mr C.Sumon, learned counsel for the petitioner and Mr Pasala Ponna Rao, learned Deputy Solicitor General of India appearing for the respondents. 3. As seen from the proceedings sheet, on 25.02.2025 learned counsel for the respondents sought time to ascertain whether the petitioner is still in service or not. 4. Today, on hearing, Mr Pasala Ponna Rao, learned Deputy Solicitor General of India appearing for the respondents has furnished a copy of the instructions issued by the 4th respondent, dated 03.03.2025, wherein it is stated that the petitioner who is working in this NCC unit as “Casual Labour” discontinued to report to this unit for duty after October 2013 and never came back for duty as per the records of this Court. 5. Learned counsel for the petitioner submits that inspite of his best efforts the whereabouts of the petitioner is not known. 6. Recording the submission of the learned counsel for the petitioner, the Writ Petition is closed. There shall be no order as to costs.
