Mr. Pantu Deb Roy, AGP Mr. Pannalal Bandopadhyay …for the State. Petitioner is aggrieved by inaction of the police authorities as the petitioner is unable to construct the building. Petitioner complains that his labourers and masons are being threatened and assaulted by the private respondents. 2 Learned advocate for the private respondents submits that already T.S. No. 709 of 2025 and T.S. No. 963 of 2025 is pending. State has already drawn up proceedings under section 126 of the BNSS. In view of the fact that the petitioner claims that his masons and labourers have been assaulted and police authorities did not take any steps, petitioner would be at liberty to approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would pass necessary directions after assessing and ascertaining regarding the truth and genuinity of the allegations. It is further directed that the police authorities would keep a vigil and take steps in case they find that there has been any violation of law and order. With the aforesaid observations WPA 17446 of 2025 is disposed of. Report submitted be kept with the record.
