NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, challenging the order dated 18.10.2023 vide Annexure-Q, whereby the respondents refused to grant interest for the delayed payment on retirement benefits. 2. The petitioner was appointed as an Assistant Task Force Commander in the year 1979. He was retired as Assistant Executive Engineer on 30.09.2013. Thereafter, his retirement benefits have not been paid and he has approached this Court in W.P.No.11659/2023. This Court, by order dated 26.06.2023 vide Annexure-H, directed the respondents to consider the representation filed by the petitioner. Thereafter, finally, pursuant to the order - 3 - HC-KAR NC: 2025:KHC:22299 WP No. 27795 of 2023 passed by this Court, the respondents have paid the retirement benefits, but for the delayed payment, no interest has been paid. Hence, the petitioner submitted a representation vide Annexure-P dated 04.10.2023. In response to Annexure-P, the impugned endorsement has been issued denying the interest for the delayed payment. Therefore, the petitioner is before this Court. 3. The learned counsel for the respondents filed a memo dated 23.06.2023, enclosing the office order related to one Rathnakumar, Chief Engineer, wherein they have paid @ 9% interest p.a. for the delayed period and submits that 9% interest will be paid to the petitioner for the delayed payment. 4. In view of the above, the following order is passed: (i) The writ petition stands disposed of. (ii) The order dated 18.10.2023 vide Annexure-Q is quashed. - 4 - HC-KAR NC: 2025:KHC:22299 WP No. 27795 of 2023 (iii) The respondents are directed to pay interest @ 9% p.a. for the delayed payment of retirement benefits from the date of retirement till the date of payment.
