HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 06/01/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.343/2024, registered at Police Station Gumanpura, District Kota City, for the offence(s) under Sections 420, 406, 384 and 120-B of IPC.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is argued that there was transaction between the accused-petitioner and the complainant since 2019. The complainant has falsely implicated the accused-petitioner, alleging that the accused-petitioner threatened him and demanded Rs.50,00,000/-. The accused- petitioner is in custody since 02.09.2024 and the trial of the case
[2025:RJ-JP:473] (2 of 3) [CRLMB-15961/2024] may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of bail application. 4. It is contended by learned counsel for the complainant that the accused-petitioner is a history-sheeter and against him 20 cases have been lodged under the various offences. It is also argued that in FIR No.493/2018 registered against the accused- petitioner for the offences under Sections 307 and 227 read with Section 148 of IPC. The Co-ordinate Bench vide order dated 22.03.2021 cancelled the bail of the accused-petitioner with the observation that the accused-petitioner was involved in criminal activities and continuously threatened the complainant, therefore, considering the evidence available on the record and conduct of the accused-petitioner, the bail application may be dismissed. 5. Heard and perused the material available on the record. 6. It is not desirable to express anything on the merits of the case, the fact narrated in the FIR shows that the complainant has given Rs.29,00,000/- to the accused-petitioner and was continuously demanded the said money from the accused- petitioner. At this juncture, no other facts are relevant considering the above facts, I deem it just and proper to enlarge the accused- petitioner on bail. 7. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Aslam Sher Khan @ Chintu S/o Ahmed Ali, in connection with FIR No.343/2024, registered at Police Station Gumanpura, District
[2025:RJ-JP:473] (3 of 3) [CRLMB-15961/2024] Kota City, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so. 8.
8. The accused-petitioner is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned Police Station. The SHO of the concerned Police Station shall send the presence report of the accused-petitioner to the trial Court, every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
