1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard from the learned counsel for the Petitioner and the learned ASC for the State.
3. Upon hearing from the learned counsels of both the sides, it is felt proper to dispose of the writ petition finally after setting aside the impugned order dated 30.09.2024 (Annexure-4) passed in SRP No.458 of 2019 by the Addl. Commissioner, Settlement & Consolidation, Berhampur, Ganjam (Opp. Party No.2), as the case land was Inam Land and the settlement of the same needs to be considered as per law i.e. under OEA Act, because in the like nature matter involving Inam Land in S.R.P. No.1209 of 2016, the Addl. Commissioner, Settlement & Consolidation, Berhampur:II, Ganjam has passed an order directing the Tahasildar to consider the prayer of the petitioner as per the provisions of the OEA Act, for which, on the basis of the submissions of the learned counsel for the petitioner, the impugned order passed in SRP No.458 of 2019 is set aside and the matter vide S.R.P. No.458 of Kunja Bihari Panigrahi ..... Petitioner(s)

2019 is remitted back to the Addl. Commissioner, Settlement & Consolidation, Berhampur, Ganjam (Opp. Party No.2) to dispose of the same afresh within a period of 2 (two) months from the date of communication of this Order taking into account the like nature of
order passed in S.R.P. No.1209 of 2016, because, similar nature of orders are required to be expected in similar matters, for no other reasons, but for the fairness and uniformity of justice.
4. Registry is directed to communicate this Order to the Addl. Commissioner, Settlement & Consolidation, Berhampur, Ganjam (Opp. Party No.2) immediately.
5. Accordingly, the writ petition is disposed of finally.
6. Urgent certified copy of this Order be granted to the petitioner on proper application.
