02/17.10.2025 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Radhanagar P.S. Case No.251/2025, registered for the offence under Sections 69/89/352/115(2) of the BNS, pending in the Court of the learned Judicial Magistrate, Rajmahal.

Learned counsel appearing for the petitioner submits that the informant is a divorced lady and she was earlier married to another man and subsequently she has come into contact with the petitioner on 25.06.2024. He further submits that the allegations are there of establishing relationship. He then submits that the FIR has been lodged on 02.07.2025. By way of referring supplementary affidavit, he next submits that the petitioner has already solemnized marriage on 28.02.2025 and the Nikahnama has been annexed in the supplementary affidavit.

Learned counsel appearing for the State submits that the allegations are there of establishing relationship on the pretext of marriage.
5. Considering that the petitioner is a divorced lady and relationship was established on 25.06.2024, however, FIR has been lodged on 02.07.2025 and

in the supplementary affidavit, prima facie, the document suggests that Nikahnama has been executed between the petitioner and informant and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Rajmahal in connection with Radhanagar P.S. Case No.251/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
