This application has been filed for quashing the order dated 02.07.2014 passed by the learned Judicial Magistrate, Katihar, in Complaint Case No.1395 of 2013, by which the learned Magistrate has taken cognizance against the petitioners for the offence under section 417 and 34 of the Indian Penal Code. 3. It is alleged that one Hanif Mandal died leaving behind his son Saidur Rahman and three daughters namely, Bibi Aisha Khatoon, Bibi Kulshum and Bibi Jamia. Bibi Kulsum died leaving behind two sons namely, Noor Islam and Md. Danesh. Bibi Jamia died leaving behind his son Md. Sahjahan. The complainant is the son of Noor Islam. It is alleged the all the accused persons in criminal conspiracy sold the share of land of the complainant and others to the petitioners. 4. The petitioner wants this Court to quash the cognizance order considering his defence. The defence of the petitioners cannot be seen at this stage as the matter requires investigation. Accordingly, this application is dismissed. The Patna High Court CR. MISC.
