The petitioner is apprehending his arrest in connection with Complaint Case No.796 of 2025, registered for the offence under Sections 41 and 42 of the Indian Forest Act, pending in the Court of the learned Judicial Magistrate, Chatra. 3. Learned counsel appearing for the petitioner submits that the petitioner is the owner of Hywa. He further submits that the allegations are made that 34 tons of coal was illegally loaded on the said vehicle. He then submits that the petitioner was not present on the spot. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 13 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegation is there of illegally carrying the coal. 5. Considering that the petitioner is the owner of the vehicle in question and the allegations are made of carrying 34 tons of coal and the petitioner has got no criminal antecedent and in the attending facts and circumstances ( 2025:JHHC:31918 ) -2- A.B.A. No. 6055 of 2025 of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Chatra in connection with Complaint Case No. 796 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
