The Court made the following: ORAL COMMON ORDER: Heard Sri K. Devi Prasanna Kumar, learned Counsel appearing for the Petitioners. 2. These two Civil Revision Petitions are filed challenging the two Orders passed by the Family Court-cum-VII Additional District Judge, Ananthapuramu.I.A.No.112/2025 in O.S.No.4/2018 (impugned in C.R.P.No.2705 of 2025) was filed by the Defendants therein to re-open the Defendants’ evidence. I.A.No.113/2025 in O.S.No.4/2018 (impugned in C.R.P.No.2706 of 2025) was filed by the Defendants seeking to setaside the Order passed by the Trial Judge eschewing the evidence of DW1, and then to permit the said Defendants to adduce evidence afresh. 3. The background to these two Interlocutory Applications is another I.A. bearing I.A.No.76/2025 wherein, it is prayed to call for the original document which is in the custody of State Bank of India as a collateral security called ‘Sasvitha Vikraya Khararunama’ dated 12.10.1986. The Defendants have filed I.A.Nos.112 & 113 of 2025 with a view that, if I.A.No.76/2025 is allowed, the consequential action to perform by the Defendants is to have the evidence re-opened and adduce fresh evidence on their behalf. 4. When I.A.No.76/2025 was dismissed by the Learned Trial Judge vide Order dated 16.06.2025, the aggrieved Defendant No.1 had filed C.R.P.No.1558 of 2025 before this Court challenging the Order of dismissal dated 16.06.2025 in I.A.No.76/2025. Vide Order dated 19.09.2025, this Court was pleased to allow C.R.P.No.1558 of 2025 by setting aside the Order of the Trial Judge dated 16.06.2025 in I.A.No.76/2025 in O.S.No.4/2018. 5. Learned Counsel for the Petitioners would submit that since this Court had already allowed C.R.P.No.1558 of 2025, consequently, the Defendants would be required to adduce fresh evidence and therefore, this Court is 4 required to set aside the Order passed by the learned Trial Judge dated 11.09.2025 in I.A.Nos.112 & 113 of 2025. This Court held, in the Order dated 19.09.2025 in C.R.P.No.1558 of 2025, as under: “8. Having considered these facts, this Court is of the view that the reasoning rendered by the Trial Court in dismissing the I.A.No.76 of 2025 is incorrect. Therefore, the Order passed by the Family Court-cum-IV Additional District Judge, Ananthapuramu dated 16.06.2025 in I.A.No.76 of 2025 in O.S.No.4 of 2018 is set aside. At this stage, it is made clear that this Court has not expressed anything as regards the admissibility of the said ‘Sasvitha Vikraya Khararunama’ dated 12.10.1986, as the same is left to the Trial Judge to consider on merits.” 6. Having regard to the above facts, this Court is of the opinion that the Orders passed by the learned Trial Judge dated 11.09.2025 in both the Interlocutory Applications are not sustainable in law in view of the Order passed by this Court in C.R.P.No.1558 of 2025 dated 19.09.2025. Accordingly, the Orders dated 11.09.2025 passed in I.A.Nos.112 & 113 of 2025 in O.S.No.4 of 2018 by the Learned Family Court-cum-VII Additional District Judge, Ananthapuramu are set-aside. 7. It is made clear that this Court has not expressed anything on merit as the same is left open to the Learned Trial Judge to consider on merits. 8. With these observations and directions, these two Civil Revision Petitions stand allowed. No order as to costs. 9.
