2. The petitioners are apprehending their arrest in connection with Manjhiaon P.S. Case No. 89/2025, registered under sections 126(2), 117(2), 118(1), 109, 352, 351(2) and 351(3)/3(5) of B.N.S., pending in the Court of

Learned counsel for the petitioners submits that there is case and counter case between the parties. He further submits that petitioner no.1 has lodged F.I.R being Manjhiaon P.S. Case No. 90/2025 against the informant and eighteen other persons. He further submits that on the same allegation present case has been lodged. He also submits that there is land dispute between the parties and allegations are general and omnibus. He then submits that injury has been found to be simple in nature. He further submits that petitioners have got no criminal antecedent which is disclosed in para 6 of the petition however police disclosed one criminal antecedent against petitioner no.7 i.e Manjhiaon P.S. Case 11/2021 and in this regard he submits that the said case is not against the petitioner no.7 and that case is against Samsul Hoda Khan whose name is similar to the petitioner no.7 and the said Samsul Hoda Khan faced trial and he has been acquitted. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegation of assault is there.

Considering that there is case and counter case between the parties, injury has been found simple in nature and the petitioners have no criminal antecedent which is disclosed in para which is disclosed in para 6 of the petition, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Garhwa, in

connection with Manjhiaon P.S. Case No. 89/2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
