The instant application was initially preferred by the Petitioner praying for a direction upon the Respondent Authority to make payment of retiral benefits and pension with statutory interest. 3. During midst of proceeding, vide order dated 21.10.2024 both the parties were directed to file specific 2025:JHHC:31539 2 affidavit giving details of payment, for which the petitioner is entitled. 4. Learned counsel for the Petitioner submits that since the petitioner is very old and suffering from different ailments; as such, he is not able to go to the office of respondents; as such, the respondents may be directed either to file specific affidavit as per order dated 21.10.2024 or calculate the legitimate dues of the petitioner. 5. Learned counsel for the Respondents draws attention of this Court towards counter affidavit and submits that though a separate supplementary affidavit has not been filed pursuant to the order dated 21.10.2024; however, from the counter affidavit filed earlier on 13.10.2022, it is evident that several surcharge cases were pending against the petitioner; as such, interest of justice would be sufficed by giving liberty to the petitioner to approach the concerned respondent along with all documents making his claim of retiral benefits. 6. Having regard to the aforesaid facts and circumstances of the case, the instant writ application is hereby disposed of by directing the petitioner to approach the 6th Respondent along with all documents making his claim of retiral benefits. The moment, a detailed representation will be received by the 6th Respondent, he shall verify the records of the case and if at all any legitimate dues still remains to be paid to the petitioner, the same shall be paid. A formal order should be issued in this regard. The entire exercise shall be completed for taking a decision and paying the legitimate dues, within a period of 16 weeks from the date of receipt of a copy of this order. 2025:JHHC:31539 3 7. It goes without saying that since the petitioner is very old; as such, any of his representatives duly authorized by the petitioner may appear before the 6th Respondent for doing the needful. 8.
