The instant writ application has been filed by the petitioner

for the following reliefs:
“That in the instant writ petitioner is desirous of issuance of an appropriate writ (s)/ order (s) and/ or direction (s) to respondents to promote petitioner as Associate Professor with Pay Band 4 (minimum 37400/+ AGP of 9500/) according to Carrier Advancement Scheme (para 3(i) & (ii) of MHRD letter no 3-27/2009-TS-11 dated 30th December 2009) is due since 15.02.2013. AND For issuance of further writ/ order/ direction to take necessary action for correct fixation of pay (minimum of Rs. 30,000+ AGP 8000/p.m.) from 15.02.2013 onwards OR to correct fixation of revised basic pay (minimum of RS. 30,000/ + AGP 8000/- p.m.) of Assistant Professors in the pre revised scale of Rs. 12, 000 RS. 18, 300 Basic Pay ranging from Rs. 12, 000/ to Rs. 15,780/p.m. will be placed at the minimum of Rs. 30,000/p.m. from 15.02.2010 onwards as per. F. NO.1/1/20081C Ministry of Finance date 30.08.2008; Para 8(IV) (A) of MHRD Letter F. NO.23-1/2008TS.II dated 18.08.2009; Para 3 and Para 3(I) & (II) of MHRD letter no 3-27/2009 TS II dated 30.12.2009. AND For issuance of further writ/order/ direction to pay all arrears of salaries dues under the Carrier Advancement Scheme (para 3(i) & (ii) of MHRD letter no 3-27/2009-TS-II dated 30th December 2009) to the petitioner in consequent. AND For issuance of further writ/order/direction as Your Lordships may deem fit and proper for doing conscionable justice to the petitioner.”

Learned counsel for the petitioner draws attention of this Court towards several Annexures and submits that the same would indicate that injustice has been committed to this petitioner.

However, at the outset, Mr. Anoop Kumar Mehta, learned counsel for the respondents submits that the petitioner has been promoted in a different scheme of promotion vide letter dated 30.05.2016 which is at Annexure-H to the counter-affidavit dated 22.07.2016 which he has accepted on 31.05.2016 endorsing as under :
“Dear Sir, I accept the offer for the post Associate Professor in the Department of Environmental Science and Engineering, ISM, Dhanbad dated.”

In view of the aforesaid acceptance, learned counsel for the respondents fairly submits that now the grounds raised in the instant writ application would amount only for academic discussion, inasmuch as, the petitioner has already accepted the promotion which was offered to him.

Having regard to the aforesaid facts and circumstances, since the petitioner has already accepted the offer for appointment to the post of Associate Professor in the Department of Environmental Science and Engineering, ISM, Dhanbad on 31.05.2016 i.e. the very next date when he was offered the same on 30.05.2016, as such, nothing remains to be adjudicated in this case.

Accordingly, the instant writ application is disposed of without any direction.
