The petitioner has been made accused in connection with POCSO Case No.40 of 2023 arising out of Sursang P.S. Case No.07 of 2023, for the offence registered under Section 376 DA of the Indian Penal Code and Section 6 of the POCSO Act, pending in the court of learned Exclusive Spl. Judge, POCSO Court-cum- Additional Sessions Judge-II, Gumla. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No.11834 of 2023 by order dated 02.04.2024. Petitioner and co-accused persons are said to have raped the victim. This is case of gang rape. Considering the nature of allegation, I am not inclined to release the petitioner, on bail.
