1. The present writ petition has been filed following reliefs:-
“(i) For issuance of an appropriate writ/ writs, order/ orders, direction/ directions for quashing of Letter Contained in Reference No. 1936 dated 09.09.2017 issued by the respondent no.2 (Annexure-5) whereby and whereunder the respondent no.2
directed the petitioner to fulfil the criteria of 0.99 acres for each employment and submit the land ownership documents of 0.99 acres of the plots of land in the patch of 33.71 acres in Mouza Nagrikalan 230 in which no benefit has been provided as yet to enable M/s Bharat Coking Coal Limited to fulfil the claim of employment/compensation as per norms. (ii) Upon quashing of Letter Contained in Reference No. 1936 dated 09.09.2017 issued by the respondent no.2 (Annexure-5) further be pleased to pass appropriate writ/writs, order/ orders, direction/ directions upon the respondent no.2 to provide employment/compensation to the petitioner.”
2. The land in question has been acquired by the respondents and it is admitted position that the land is a raiyati land. Thus, compensation has to be extended. But only dispute is “whether the present petitioner is the legal heir of the awardee or not?” This dispute can be resolved only by the competent Civil Court.

3. In that view of the matter, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the competent civil court.

Learned counsel for the other side has no objection.
5. In view of above submission, the permission is accorded. Accordingly, the present writ petition is hereby dismissed as withdrawn with aforesaid liberty.
