Y RATNA PRABHA (SC FOR RAYALASEEMA UNIVERSITY) The Court made the following: ORDER: This Contempt case has been filed to punish the contemnors/respondents under the provisions of Contempt of Courts Act 1971 for violation of the orders and for not implementing the order of this Court in W.P.No.26615 of 2022, dated 02.08.2024. 2 2. Heard Sri M.R.K. Chakravarthy, learned counsel appearing for the petitioner and Sri Gurram Ramachandra Rao, learned counsel appearing for the respondents. 3. This Court, vide order, dated 02.08.2024, in W.P.No.26615 of 2022, has disposed of the writ petition. The operative portion of the same, as under: “…In view of the above submissions, this Court is inclined to dispose of the writ petition with a direction to the respondents to take services of Dr.L.V. SubbaReddy as Assistant Registrar (Finance) on contract basis against the existing vacant post of the Assistant Registrar. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs..” 4. Learned counsel for the petitioner submits that, though this Court has given a direction to the respondents to take services of the petitioner as Assistant Registrar on contract basis, but the respondents have not passed any orders or even they are not even allow the petitioner to meet them personally. Therefore, the petitioner got issued a legal notice dated 22.10.2024 and despite receipt of the same, the respondents did not choose to implement the order of this Court dated 02.08.2024 passed in WP No.26615 of 2022. 5. On the other hand, learned counsel for the respondents submits that, in obedience of the order of this Court and directions of the Executive Council, Vice Chancellor has issued proceedings vide No.RUK/N.T.Estt./High Court Order/Contract appointment/LVSR/2024-25, dated 28.01.2025, wherein, the Vice Chancellor has ordered that Dr L.V. Subba Reddy is temporarily appointed as Assistant Registrar on contract basis against the vacant post of Assistant Registrar for a period of one year on the consolidated pay of Rs.57,600- and 3 this appointment is purely on temporary basis and will be terminated with the appointment of regular Assistant Registrar or completion of the period whichever is earlier. 6. Learned counsel for the respondents has also placed a copy of proceedings of the Vice Chancellor vide No.RUK/N.T.Estt./High Court Order/Contract appointment/LVSR/Revised order/2024-25, dated 18.02.2025, wherein it is stated that the contractual employment of the petitioner may be terminated with one-month prior notice whenever the services of the aforesaid individual are not required for the University or can be terminated with the appointment of regular Assistant Registrar. It is also stated that the petitioner will be governed by the rules and regulations that are in force of the University and Government of Andhra Pradesh that may be amended from time to time and the salary of Rs.57,100/- is paid as per the G.O.Ms.No.2 Finance (HR.I-Plg. & Policy) Department, dated 06.01.2025 assigned to the post the Assistant Registrar. He is also directed to report to the duty to the undersigned on or before 28.02.2025 and receive directions of the place of work. 7. On hearing the submissions of both the learned counsels and on perusing the material on record, it is observed that, this Court directed the respondents to take services of Dr. L.V Subba Reddy as Assistant Registrar (Finance) on contract basis against the existing vacant post of the Assistant Registrar. But the respondents have issued the proceedings imposing certain conditions, which is not proper on the part of the respondents, 4 8. In view of the same, this Court is of the considered view to grant two (02) weeks time to the respondents to implement the order of this Court dated 02.08.2024 in W.P.No.26615 of 2022 in a letter and spirit manner, from the date of receipt of a copy of this order. 9.
