Mr. Abhishek Kumar, Advocate For the State :Ms. Ruby Pandey, A.P.P. ----- 07/ 02.05.2025 Heard the parties.
2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 20(b)(ii)(A)/15/18/19B of the NDPS Act.
3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail.
4. Truck is a commercial vehicle and it was transporting coal. The petitioner is the owner of the truck. From the driver’s cabin 510 grams of opium and 2.30 kg of doda were recovered. Prima-facie, considering the quantity of the material and since it was found from the cabin of the driver, I am of the opinion that it was being done without the consent of the owner of the vehicle, thus this Court finds it a fit case for grant of anticipatory bail to the petitioner.
5. Accordingly, this Anticipatory Bail Application stands
