THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER Petitioner is before this Court seeking regular bail in S.C.No.1030/2021 pending before the Court of LXIX Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.272/2009 registered by Indiranagar Police Station, Bengaluru for offences punishable under Sections 143, 448, 323, 427, 307, 506 read with Section 34 of IPC and Section 25 of the Arms Act. 2. Learned Counsel for the petitioner submits that accused No.3 who was tried for the chargesheeted offences in S.C.No.273/2012 was acquitted by the Jurisdictional Sessions Court by judgment and order dated 24th January, 2013. The said judgment and order of - 3 - NC: 2025:KHC:11824 CRL.P No. 11962 of 2024 acquittal has attained finality. Accused No.2 and accused Nos.4 to 11 are also acquitted and the said fact is noted in the judgment passed in S.C.No.273/2012. In the present case already two chargesheet witnesses have been examined as P.W.1 and P.W.2. In S.C.No.273/2012 only six chargesheet witnesses were examined by the prosecution. Petitioner is in custody in the present case from 20.02.2020. Considering the aforesaid aspects of the matter, he submits that this petition may be disposed off with a direction to the Trial Court to expedite the Trial and dispose off the case within time frame. 3. Learned HCGP fairly does not oppose the prayer made by the learned counsel for the petitioner. He submits that if three months time is granted; an endeavor shall be made to complete the trial. 4. Petition is disposed off with a request to the Trial Court to complete the trial and dispose off the case on merits as expeditiously as possible, but not later than a period of three months from the next date of hearing before the Trial Court.
