Hon’ble Shri Arvind Kumar Verma, Judge Order on Board 08/08/2025 1. With the consent of parties, the matter is heard finally 2. By way of this petition, the petitioners are challenging the inaction on the part of the District Education Officer, Korba, (C.G.) who is not taking any action upon the complaint/application of the petitioner No. 1 submitted before the Collector Jan Chaupal Korba (C.G.) bearing token No. 2050124000585 dated 11.03.2024. The investigation/enquiry initiated by the District Education Officer, Korba (C.G.) has now come to a standstill and the pendency of the proceedings is violative of the legal, constitutional rights of the petitioners. 3. Learned counsel for the petitioner further submits that It is the complaint of petitioners that the name of the father of their grandson (Shubhansh Agrawal) is wrongly written as Mr. Rakesh Kumar Singhania in his school records which should be the late Mr. Nilesh Agrawal. The late Mr. Nilesh Agrawal is/was the son of the present petitioners and post his sad demise on 01.07.2018, the daughter-in-law of the petitioners is living with some other person by the name Mr. Rakesh Kumar Singhania. It is the legal & constitutional right of the petitioners to have the identity of their offsprings/children and 3 the concerned school authorities are acting in violation of their rights by entering the name of the father of Shubhansh Agrawal as Mr. Rakesh Kumar Singhania in his school records which should be the late Mr. Nilesh Agrawal. 4. Lastly, learned counsel for the petitioner submits that the investigation/enquiry being conducted by the District Education Officer, Korba (C.G.) is long pending and has now come to a standstill, the petitioners have approached this Hon'ble Court seeking a very limited prayer, inter alia, that the District Education Officer, Korba (C.G.) may be directed to conclude the proceedings by taking appropriate action/decision upon the complaint of the petitioner no. 01 made before the Collector Jan Chaupal, Korba (C.G.) bearing token 2050124000585 dated 11.03.2024 within a stipulated time period, preferably within 15 days. 5. Learned counsel for respondents submits that if the complaint of the petitioner No. 1 is pending, the same shall be decided at the earliest in accordance with law. 6. I have heard learned counsel for the parties and perused the material available on record. 7. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the competent authorities to conclude the proceedings upon the complaint of the petitioner 4 No. 1 made before the Collector and decide the same after giving sufficient opportunity of hearing to the parties of the case, on its own merits in accordance with law, rules and regulations as expeditiously as possible. 8.
