[2025:RJ-JP:4099] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 19750/2024 1. Smt. Bulbul Wife Of Chandraveer, Resident Of Jatoli Rathbhan, Tehsil And District Bharatpur (Raj.) 2. Smt. Preeti Wife Of Ajeet, Resident Of Jatoli Rathbhan, Tehsil And District Bharatpur (Raj.) ----Petitioners Versus 1. Rahul Son Of Shri Ramesh, Resident Of Jatoli Rathbhan, Tehsil And District Bharatpur (Raj.) 2. Sub-Registrar Bharatpur, Registration And Stamp Department, Bharatpur (Raj.) 3. State Of Rajasthan, Through District Collector, Bharatpur (Raj.) ----Respondents For Petitioner(s) : Mr. Deepak Sharma For Respondent(s) : HON'BLE MR. JUSTICE SUDESH BANSAL Order 29/01/2025 1. Instant civil writ petition under Article 227 of the Constitution of India filed by the petitioners, impugning the order dated 20.11.2024 passed by District Judge, Bharatpur in civil suit No.91/2023, allowing the application under Order 7 Rule 14 (3) CPC filed by the respondent-plaintiff and to take the report of handwriting expert on record. 2. After arguing the writ petition for some time, counsel for the petitioners does not dispute that petitioner-defendants have opportunity to rebut the report of handwriting expert and the present suit is still at the stage of cross-examination of plaintiff, [2025:RJ-JP:4099] (2 of 2) [CW-19750/2024] hence, in that view, he seeks permission to withdraw the writ petition with liberty to impugn the report of handwriting expert before the Trial Court itself. 3. In view of above and without interference to the impugned order, the instant writ petition stands disposed of with liberty prayed for. 4. Stay application and any other pending application, if any, stand disposed of. (SUDESH BANSAL),J TN/68
